If you are employed by a National Express group company the National Express group company that employs you is the controller of your personal data collected for the purposes explained in this privacy notice.

This will be that one of the following named National Express group companies that is specified in your contract of employment:

  • National Express Limited
  • West Midlands Travel Limited

If you are employed by a third party operator National Express Limited is the controller of the personal data collected for the purposes explained in this privacy notice.

The data controller’s representative for the purposes of this privacy notice is the National Express UK Data Protection Officer, who can be contacted using the contact details set out at the end of this notice.

2. What personal data is collected from and/or about you on this Website?

We collect your personal data in a variety of ways, including:

  • from you and/or your manager when you or they add comments to this Website in relation to you
  • by way of cookies, please see our cookie policy by clicking here for more information about how we use cookies
  • from telematics systems operating on transport services performed for us.

3. What will we do with your personal data?

If you are employed by us we will use the personal data to facilitate training, assessments, performance management and, where appropriate, discipline and removal.

If you are employed by a partner operator we make such personal data available to the partner operator for their use in accordance with their policies and procedures and, where appropriate, to require the operator to suspend and/or remove you from the provision of transport services to us.

For data analysis, research and statistical purposes in relation to personal data collected by way of analytical cookies on this Website.

We process your personal data on the basis of your consent (in respect only of cookies), our legitimate interest or where we have a legal obligation to do so.

Where we process your personal data only on the basis of our legitimate interest, you have the right to object to our use of your personal data. However, we do not have to stop processing personal data where we have compelling grounds that override your interests, or where we need to process your data in order to establish, exercise or defend legal claims. If you have any objections please contact the National Express UK Data Protection Officer (see details below).

Where we use your information because we have a legal obligation to do so, there is no right to object.

4. Will we share your personal data with someone else?

Your personal data may be shared by us with our group companies.

If you are employed by a partner operator your personal data will be shared with that partner operator.

Your personal data will also be shared by us with those suppliers who provide services in connection with our business, including (without limitation) suppliers of information technology services and suppliers who provide host and maintain our information technology infrastructure, websites and applications.

Your personal data may be shared by us with third parties, including law enforcement agencies, where we are legally obliged to disclose your personal data or where we consider that there is a risk to health and safety.

While the majority of our group companies and suppliers are located with the EEA (or, in the case of suppliers, provide their services to us from the EEA), certain of our group companies and suppliers are located outside the EEA and, in such cases, we have entered into appropriate agreements with those group companies and suppliers such that your personal data should be afforded the same level of protection as when it is processed in the EEA.
